SECTION 189

(1) Any council board member who, without any reasonable excuse, refuses to discharge the duties assigned to him by the laws and regulations may be considered to have resigned by decision of the minister in charge of local authorities, after consulting the council board. (2) The refusal to discharge duties referred to in sub-section 1 above shall be based on a written statement sent to whom it may concern or made public by its author, or on repeated absence after formal notice by the minister in charge of local authorities. (3) The corresponding decision may be challenged before the competent court.
