Decree No. 2018/355 on common rules applicable to contracts by public corporations › Chapter 6

SECTION 61

(1) A contract shall be referred to as concluded by mutual agreement where it is passed without an invitation to tender, after the prior authorisation of the Board of Directors. (2) Where an agreement is reached, the Contracting Authority shall directly consult, without any obligation of publicity, at least 3 (three) companies, except in the cases referred to in this decree. (3) The consultation files, bids by the tenderers, as well as the authorisation to award by mutual agreement, shall be submitted for examination to the Tenders Board. The latter shall have 5 (seven) calendar days to state its proposal for award. (4) In this case, the Contracting Authority shall have 30 (thirty) calendar days, as from the moment of obtaining the prior authorisation of the Board of Directors, to sign and notify the contract.
