Decree No. 2018/355 on common rules applicable to contracts by public corporations › Chapter 6

SECTION 34

(1) An invitation to tender shall be the procedure by which a contract is awarded after a public invitation to competitive bidding. (2) The criteria for selection of the successful bidder shall take into account: - the price of works and services, reductions and variants proposed or the cost of their use; - technical and functional value, in particular, the operating and maintenance conditions, as well as the potential lifespan of the structure produced or of the supplies and services concerned; - the quality and professional capacity of participants; - the implementation or delivery time. ((3) An invitation to tender may be valid only if, after complying with all the provisions of this decree, the relevant Internal Tenders Board receives at least one bid that is deemed admissible.
