(1) A consultation may be declared unsuccessful in the following cases:
- no candidate participated in the consultation;
- none of the offers received complied with the consultation file;
- the amount of each offer received is higher than that of the provisional budget;
- the procedure followed does not comply with the regulations in force.
(2) Nevertheless, a consultation may only be declared unsuccessful following the
opinion of the competent Internal Tenders Board.
(3) Any declaration of unsuccessful consultation shall be materialised by a decision
published in accordance with the procedure and the time-limits provided for by this
decree.
