(1) In cases of total or partial failure of the
attempt at conciliation to which reference is made in the
preceding section, the action shall be instituted by an oral or
written declaration made to the registrar of the competent court
by the most diligent party.
(2) In order to be receivable, the said declaration shall be
accompanied by a copy of statement of non-conciliation or of
partial conciliation.
(3) The said declaration shall be entered in a register kept
specially for the purpose, and a certificate of the entry shall be
delivered to the party instituting the action.
