Règlement d'arbitrage de la Cour Commune de Justice et d'Arbitrage › Chapter 2

SECTION 14 — Confidentiality of the arbitral proceedings

Arbitral proceedings shall be confidential. The work of the Court relating to conduct of arbitral proceedings is subject to this confidentiality; so too is the meeting of the Court held for the purpose of supervision of the arbitration. Confidentiality shall also apply to documents submitted to the Court or drawn up by it in the course of the proceedings it is following up. Unless otherwise agreed by all the parties, the parties and their counsel, the arbitrators, the experts and any person involved in arbitral proceedings shall be bound by the duty to respect the confidentiality of the information and documents produced during the said proceedings. Confidentiality shall extend, under the same conditions, to the arbitral awards.
