SECTION 89

(1) In the absence of more favourable in the collective agreement or individual employment contract, paid leave at the employer's expense shall accrue to the worker at the rate of one and a half working days for each month of actual service. (2) Any period equivalent to 4 (four) weeks or 24 (twenty-four) days of work shall be deemed to be 1 (one) month of effective service. (3) For the calculation of leave, periods of effective service shall be : • (a) Periods of unavailability due to industrial accident or occupational disease; • (b) Absences, not exceeding 6 (six) months, stemming from illness duly certified as provided for under Section 32 above : • (c) Maternity leave provided for under Section 84 above; • (d) Lay-offs as provided for under Section 32 above. (4) A maximum of 10 (ten) days per year of paid special leave of absence, not deductible from annual leave, shall be granted to workers on the occasion of family events directly concerning their own home. A decree issued after consultation with the National Labour Advisory Board shall determine the procedure for implementing this sub-section.
