Where registration concerns the preferential rights of the Treasury the competent Public
Accounting Officer shall present the following to the Registry of the competent court within
whose jurisdiction the debtor is registered:
1°) the original copy of the written instrument in proof of the debt, or the court ruling authorising
the Treasury to register the preferential rights;
2°) four copies of a registration form specifying:
a) the full names, corporate name, residence or registered office of the debtor, as well as
his registration number;
b) the nature and date of the debt;
c) the amount of money due on the last day preceding the registration of the preferential
right and, where applicable, the conditions under which the debt shall due payment;
d) the Treasury’s address of service within the jurisdiction of the court where the Trade
and Personal Property Rights Register is kept.
After ascertaining that the form is in conformimity with the written document referred to above,
the Registry shall proceed with the registration in accordance with the conditions stipulated in
Article 49 above.
Any modification by agreement or court order of the preferential right shall be entered as an
amendment in the Register under the same conditions and in the form stipulated in the initial
entry.
