SECTION 57

Where registration concerns the preferential rights of the Customs Department the latter shall present the following to the Registry of the competent court within whose jurisdiction the debtor is registered: 1°) the original of the written instrument in proof of the debt, or the court decision authorising the Customs Department to register the preferential right; 2°) four copies of a registration form stating: a) the full names, corporate name, residence or registered office of the debtor against whom the entry is made, as well as his registration number; b) the nature and date of the debt; c) the amount of money due on the last day preceding the registration of the preferential right and, where applicable, the conditions under which the debt shall be due payment; d) the Customs Department’s address of service within the jurisdiction of the court where the Trade and Personal Property Rights Register is kept. After ascertaining that the form is in conformity with the documents referred to above, the Registry shall registry in accordance with the conditions stipulated in Article 49 above. Any modification by agreement or court order of the preferential right shall be entered as an amendment in the Register under the conditions and in the forms stipulated for the original entry.
