SECTION 51

Where the subject of a pledge is professional equipment belonging to a natural or corporate person subject to registration in the Trade and Personal Property Rights Register, the pledgee shall present to the Registry of the competent court within whose jurisdiction the purchaser is registered: 1°) the original copy of the security deed if it is a private contract, or a copy if it is a notarised deed or a court decision authorising the creditor to register the pledge; 2°) four copies of a registration form stating: a) the full names, corporate name, residence or registered office of the parties, as well as the registration number of the purchaser against whom the pledge is registered; b) the nature and date of the filed pledge agreement(s); c) a description of the property to be pledged to facilitate its identification and location, and an indication, where necessary, that the property is likely to be moved; d) the amount of the money due on the last day preceding the registration of the pledge and, where applicable, the conditions under which the debt shall be due payment; e) the pledgee’s address of service within the jurisdiction of the court where the Trade and Personal Property Rights Register is kept.
