SECTION 247

Where, for contracts which involve successive deliveries, the failure by one of the parties to meet an obligation relating to a delivery constitutes a fundamental breach of the contract, the other party may bring an action before the competent court to terminate the contract. He may at the same time claim for the goods already delivered or for future deliveries where, by virtue of their connexity, such deliveries may not be used for the purposes intended by the parties at the time the contract was entered into.
