SECTION 254

The purchaser shall apply to the competent court to cancel the contract: - where failure by the vendor to comply with any of his obligations or these provisions constitutes a fundamental breach of the contract; or - where the vendor again fails to deliver the goods within the additional time limit granted to him. However, where the vendor has delivered the goods, the purchaser’s right to consider the contract terminated shall be forfeited where he fails to terminate it within reasonable time: - in case of a late delivery, from the time when he knew that the delivery had been made; - in case of a breach other than the late delivery.
