(1) The use of restricted invitations to tender shall be mandatory for
intellectual service contracts.
(2) Restricted invitations to tender may also be used for the following:
(a) specific major or complex works or equipment;
(b) supply of material to be manufactured on order and specialized services.
(3) The Project Owner or the Delegated Project Owner may be granted a waiver
on the prequalification process:
-
for intellectual services under jobbing orders;
-
where prequalification is unsuccessful or ends up with less than 3 (three) bidders
per lot;
-
where the contract award schedule prepared in accordance with the regulations in
force shows that the time necessary to complete the procedure is such that
projected start or completion dates may not be met;
-
where the invitation to tender concerns service providers selected by category.
