SECTION 216 — Usurpation of Office

(1) Whoever assumes any public office, whether civil or military, to which he is not appointed, or performs any act belonging to any such office, shall be punished with imprisonment for from 6 (six) months to 5 (five) years. (2) In the case of a public servant continuing to act in an office after official notice of his cessation from the said office, whether temporary or final, the punishment shall be imprisonment for from 3 (three) months to 2 (two) years. (3) On conviction the Court may also impose the forfeitures described by section 30 of this Code. (4) Where the offender takes advantage of his usurpation to commit any offence defined by Chapter III of this Part, he shall be punished as if he held the office usurped.
