Criminal Procedure Code › Book 1 › Title 1

SECTION 3

(1) The sanction against the infringement of any rule of criminal procedure shall be an absolute nullity when it is: (a) Prejudicial to the rights of the defence as defined by legal provisions in force; (b) Contrary to public policy. (2) Nullity as referred to subsection (1) of this section shall not be overlook be raised at any stage of the criminal proceedings by any of the parties and shall be raised by the trial court of its own motion.
