SECTION 31

The application to open collective proceedings may be made within the time limit of one year following the date the debtor is struck off the Trade and Personal Property Rights Register if his insolvency preceded his being struck off the register. The application to open collective proceedings may also be made against a partner whose liability is joint, several and indefinite for the company’s debts within a period of one year where payments are suspended before his withdrawal from the Trade and Personal Property Rights Register is recorded. In both cases the competent court may commence proceedings on its own motion in accordance with the conditions laid down in Articles 28 and 29 above or the matter may be referred to it on the application of any of the creditors.
