SECTION 36

Every decision to commence collective proceedings shall without delay be entered in the Trade and Personal Property Rights Register. Where the debtor is a non-trading private company, the entry shall be made in the chronological register; in addition, a form shall be drawn up in the name of the party concerned in the alphabetical index card mentioning the decision concerning the party; the full name and address of the manager(s) as well as the registered office of the company shall also be mentioned. An extract of the decision including the other entries shall also be published in a newspaper empowered to publish legal notices within the jurisdiction of the competent court. A second publication shall be made, under the same conditions, after a period of fifteen days. In addition to the information provided for in this article, the two extracts shall contain a notice to creditors to file their claims to the Bankruptcy Trustee. The notice shall contain a full reproduction of the provisions of Article 78 of this Uniform Act. The same publication shall be made at the debtor’s or the company’s main business places. The above publication shall be made as a matter of course by the registrar of the court.
