The vendor shall deliver the goods according to the quantity, quality, specification, and
packaging as provided for in the contract.
Unless otherwise agreed by the parties, the goods shall only be considered to conform to the
contract where:
1. they are merchantable, that is to say, they are fit for the purpose goods of that nature are
generally used;
2. they can properly serve any special purpose which was brought to the knowledge of the vendor
at the time of the contract;
3. their characteristics conform to any sample or model which was given to the purchaser by
the vendor;
4. they are packaged according to the usual method of packaging goods of the same nature or,
if there is no such usual method, in a manner to ensure their conservation and protection.
