SECTION 111

The conditions laid down in Article 109 above shall not be applicable to: - the State; - local governments; - Public corporations; - legally incapable persons, with regard to the business they owned prior to the onset of their incapacity; - the heirs or legatees of a deceased trader regarding the business run by the latter; - management lease schemes signed by a court appointed officer in the course of a receivership proceeding responsible in whatever capacity for the running of a business, provided that they have been so authorised by the competent court and that they have been published in the newspaper authorized to publish legal notices.
