(1) Special contracts shall be contracts, which do not meet, in full or in
part, the conditions relating to contracts awarded through invitation to tender or by
mutual agreement. They include, for the most part, contracts relating to national
defence, security, and strategic interests of the State.
(2) The contracts referred to in (1) above include clauses that are secret, for security
reasons and the strategic interests of the State, and shall therefore not be subject to
examination by any public tenders boards provided for under this decree.
(3) The contracts referred to in (1) above shall concern only the purchase of
equipment or supplies, and any services directly related to national defence, security,
and the strategic interests of the State.
