SECTION 53

Where the prescribed time-limit of the preceding section are not observed, the following rules shall apply: (a) If the person summoned does not appear, the summons shall be cancelled either by the court or by the Examining Magistrate who shall order that a new summons be issued. (b) If the person summoned appears, he shall be informed that he has been irregularly summoned and that he has a right to either apply for an adjournment, accept to be heard or to have the matter proceeded with.
