SECTION 428

(1) In case of any application to set aside a judgment in default, the execution to the judgment shall stayed. However, the warrant issued by the court or the award granted in accordance with the provisions of section 392 shall remain enforceable. (2) The application to set aside a judgment in default may be limited to the criminal or civil aspect of the judgment.
