(1) If the court is not yet in a position to assess the quantum of damages due to the civil party, it may, subject to the conditions provided by law, make an award to him which should be enforced notwithstanding any object or appeal.
(2) In case of non-payment, the award shall bear interest at the legal rates in force as from the date of the judgment.
