SECTION 396

(1) (a) Any accused person who is detained but finally acquitted or whose imprisonment or fine is finally suspended shall, without prejudice to the application of the provisions of section 393 as regards costs, be immediately set free unless the detention is for some other reason. (b) The same shall apply where he is sentenced to a term of imprisonment which is equal to or less than the period of remand. (2) In case of fine which is not suspended, the provisions of section 393 shall apply.
