SECTION 371

(1) If it appears to the court that the accused is of unsound mind, it shall, by an interlocutory decision, order an expert to produce a medical report and shall adjourn the hearing to a later date. (2) If it can be deduced from the report that the accused is of sound mind, the proceedings shall continue in accordance with the provisions of section 365. (3) If it is found that the accused is of unsound mind, the court shall order his confinement in a health institution and stay the proceedings. The provisions of sections 44 (2) of the Penal Code and 68 (3) (b) of this Code shall be applicable.
