SECTION 289

(1) The Court of First Instance shall have jurisdiction to try simple offences and misdemeanours as defined in section 21 (1) (b) and (c) of the Penal Code. (2) Where the Court of First Instance tries a simple offences, it shall apply the same procedural rules as in the case of misdemeanours, with the exception, of those rules applicable to misdemeanours committed flagrante delicto.
