SECTION 263

(1) Issues of procedure raised but not adjudicated upon in the course of a preliminary inquiry shall be jointly brought with the main case before the competent trial court. However, they shall be raised before the trial of the case on the merits. (2) The court seized of the matter shall declare an act which it considers irregular null and shall determine the scope of its effects. However, the decision of the Inquiry Control Chamber committing the defendant to the court having jurisdiction in matters of felony shall expunge definitely all the nullities of the previous proceedings.
