(1) Where the work is carried out in the workshops
or other business premises of the contractor, he shall, where the
subcontractor becomes insolvent, assume the subcontractor's
obligations towards the workers.
(2) Where the work is carried out a place other than the
workshop or other business premises of the contractors, he shall,
if the subcontractor becomes insolvent, be reponsible for
payment of the workers' wages.
(3) An aggrieved worker shall, in the above case, have the right
to institute direct action against the contractor.
(4) However, the provisions of Sub-sections (1), (2) and (3)
above shall not apply where the subcontractor is registered in the
trade register and holds a valid business licence.
