Pursuant to an arbitration clause or submission agreement, any party to a contract may submit
a contractual dispute to arbitration as provided for in this part, where one of the parties is
domiciled or has his usual place of residence in the territory of a State Party, or where the contract
is performed or will be performed wholly or partly in the territory of one or more States Parties.
The Common Court of Justice and Arbitration shall not itself settle such a dispute. It shall appoint
or confirm arbitrators who shall keep the court informed of the progress of the proceedings and
submit the draft award to the court for its approval in conformity with article 24 below.
