Where an intermediary acts on behalf of a principal within the scope of his authority, his acts
shall only bind the intermediary and the third party where:
- the third party did not know or was not supposed to know the status of the
intermediary; or
- where circumstances of the case, with particular reference to a commission contract,
show that the intermediary only intended to bind himself.
