SECTION 148

Notwithstanding the provisions of the section 147, the obligation to commence the inquiry shall cease when the Examining Magistrate discovers that, for reasons affecting the criminal prosecution itself, the facts cannot legally sustain a prosecution, or the facts do not legally constitute a criminal offence, or that the suspect has immunity.
