Decree No. 2005/481 of 16 December 2005 to amend and supplement some provisions of Decree No. 76/165 of 27 April 1976 to establish the conditions for obtaining land certificates › Title 0

SECTION 39 — (nouveau).- (1) Lorsque des omissions ou des erreurs ont été commises shall transmit to the parties a copy of the said deed after cancelling on it the property to be registered.

35. (new) Each registration shall entail the establishment, by the Land Conservator, of a land certificate which must include: - the description of the property with détails of its composition, contents, situation, boundaries and adjacent areas; - détails of owner's civil status; - the existing real rights on the property and encumbrances attached to it; - a sériai number and a spécifie name; - the situation plan of the property duly signed hy a sworn Surveyor and countersigned by the Head of the Divisional Surveys Service in whose area the property is situated. 37. (new) Where a land certificate is issued following a sale, the Land Conservator must, prior to parcelling out, transfer or merger, satisfy himself that; - the transaction has been carried out according to the provisions of Article 8 of Ordinance No. 74/1 of 6 July 1974; - the property is situated within his area of compétence and that it is the property specifled in the conveyance of the right; - the plan annexed to the certificate has been duly signed by the Head of the Divisional Surveys Service in whose area the property is situated; - the certificate is in due form with regard to the registration régulations. 39. (new) (1) Where omissions and errors have been made on the land certificate or in 1st January 2006 1581 dans le titre de propriété ou dans les inscriptions, les parties intéressées peuvent en demander la rectification.
