The procedure before the Common Court of Justice and Arbitration shall be determined by the
Rules adopted by the Council of Ministers pursuant to Article 8 above and shall be published in
the OHADA Official Gazette, as well as in the Official Gazette of the States Parties or by any
other appropriate means.
The hearing shall be in the presence of all parties. The assistance of a counsel is mandatory. The
hearing shall be in open court.
