The mortgagee-creditor whose debt has not been paid may bring an action for the transfer of
the mortgaged property in his name unless he proceeds to sell the said property in accordance
with the rules governing the attachment of real property which a mortgage contract shall not
circumvent.
He shall however not avail himself of this option where the mortgaged property is the principal
residence of the settlor.
