be conducted in accordance with the rules set
out in the Criminal Procedure Code, except
where otherwise provided for in the Code of
Military Justice. However, the complaint in
conjunction with civil action shall not be
brought before the examining magistrate.
(b) Notwithstanding the provisions of
the Criminal Procedure Code relating to
remand in custody, the examining or trial
judge may remand to custody any service-
man who commits an offence that seriously
undermines military discipline, even where
such offence is not a crime.
(2) Once the Examining Magistrate
deems that the judicial inquiry is concluded,
he shall forward the case file to the State
Prosecutor for his final submissions. The lat-
