Decree No. 2018/355 on common rules applicable to contracts by public corporations › Chapter 4

SECTION 23

(1) Before launching of any invitation for tender or consultation, the Contracting Authority shall ensure that there are preliminary studies and that the site, the funding, and the contract award plan are available. (1) The preliminary studies should take into account applicable technical, social, and environmental standards, in compliance with the laws and regulations in force; (2) Site availability shall involve the Contracting Authority taking all the necessary steps for effective release thereof beforehand; 3) The contract award plan schedules all the activities relating to the award and execution of contracts planned for the year concerned. It shall be drawn up by the Contracting Authority and approved by a resolution from the Board of Directors. A copy of the said plan shall be forwarded to the Ministry in charge of public contracts and to the body in charge of regulation; 4) Availability of funding shall start from the adoption of the budget to the release of the funds allocated to contracts.
