SECTION 461

When the court finds that the facts constitute a felony, it shall declare the Court of First Instance as having no jurisdiction, nullify the judgment of the lower court, and refer the case to the Legal Department to take appropriate action. In this case, the Legal Department having been heard, the court may in the same decision issue a remand warrant or a warrant of arrest against the accused.
