SECTION 395

(1) (a) Where the fact do not constitute an offence, the court shall acquit the accused and declare itself incompetent to proceed with the civil claim. (b) The same shall apply where facts have not been proved or where the facts though proved do not implicate the accused. (2) In case of doubt, the accused shall be acquitted. Mention of the benefit of doubt shall be made in the judgment. (3) Anyone finally acquitted or convicted of an offence shall not be retried on the same facts even under a different statement of offence.
