SECTION 96

The trustee shall, within a period of ten (10) days following the decision to open the proceedings and upon a mere decision of the receiver, pay super priority claims of workers after deduction of advances already received. Absent necessary funds for this purpose, such claims shall be settled with the first funds collected before any other claim notwithstanding the provisions of articles 166 and 168 hereinafter. The trustee or any other individual or organization that supports all or part of the wages in case of reorganization or liquidation of assets, if such a body exists in the State party concerned, which has made an advance to pay claims arising out of contracts of employment or apprenticeship, shall be subrogated to the rights of the workers and should be refunded as soon as funds are collected without any obstacles from any other claim.
