SECTION 49

The Controller shall assist the Judge Administrator in his task of overseeing the conduct of the collective proceedings and shall look after the interests of the creditors. The Controller shall always have the right to audit the accounts and check the economic and financial situation presented by the debtor; he may ask to be given an account of the state of the proceedings, the acts accomplished by the Bankruptcy Trustee as well as of the funds collected and deposits made. He shall always be consulted on whether the company should continue its activities during the verification of claims and during the sale of the property of the debtor. He may refer all disputes to the Judge Administrator who shall render his decision in accordance with the provisions of Article 40 above. The duties of the Controller shall be free of charge and shall not be delegated. A Controller shall be held accountable for his gross misconduct.
