SECTION 199

The compensatory damages shall, as least, be equal to: - one month of commission for the first year the contract was completely performed; - two months of commission for the second year the contract was completely performed; - three months of commission as from the third year the contract was completely performed. The compensatory damages shall be freely agreed upon by the commercial agent and his principal for the period after the third year the contract shall be completely performed. The monthly payment to be considered for the calculation of the damages shall be the average amount for the last twelve months of performance of the contract of agency. These provisions shall not apply where the contract is terminated due to gross misconduct on the part of one of the parties or due to an act of God.
