Any public employee holding administrative functions, whether temporary or not, of control, supervision, or counseling in a private company who, before the expiry of a period of 3 (three) years, with effect from the end of his functions, joins the managerial staff or enters into a contract of employment with the said company, shall be punished with imprisonment for from 6 (six) months to 2 (two) years or with fine of from CFAF 20 000 (twenty thousand) to CFAF 2 000 000 (two million) or with both such imprisonment and fine.
