Costs incurred by the Legal Department for commencing and carrying out criminal prosecutions and preliminary inquiries as well as the execution of judgments shall be advanced by the Public Treasury. The cost shall be borne by the party who fails except in cases where the court in its reasoned decision rules otherwise.
