The conventional mortgage shall be made in accordance with the national laws of the place
where the property is situated by the following:
- By an instrument drawn up by the competent notary or administrative or judicial official
vested with the powers to draw up such deeds; or
- By a private deed drawn up following a model accepted by the conservator of lands.
Any power of attorney given to a third party to establish a mortgage in the notarial form shall
be drawn up in the same form.
