Where goods forwarded for sale on commission are in an obviously defective condition, the
commission agent shall safeguard the rights of action against the carrier, have a report of the
damage established, take necessary measures to preserve the damaged goods and inform the
principal promptly.
Failing this, he shall be liable for the damage caused by his negligence.
Where there is cause to fear that goods forwarded under a commission for sale will deteriorate
rapidly and where the principal’s interest so requires, the commission agent shall be bound to
have them sold.
