Any creditor who has had a preferential right or a pledge entered in the Register or who has
duly lodged an objection may, within a period of one month following the publication of the
sale in a newspaper authorized to publish legal notices, make a bid which exceeds by one-sixth
the amount of the purchase price of the business indicated in the transfer agreement.
Where the business is the subject of a compulsory sale, the secured creditors and persons who
have lodged objections shall enjoy the same right to make a bid in excess of the purchase price
; this right shall be claimed within the same time limit following the auction.
In all circumstances, the highest bidder shall, within the same time limit, deposit at the Registry
of the competent court the amount of the price increased by one-sixth.
