(1) The deposit shall be refunded to the candidate:
- who is declared ineligible before the printing of ballot papers;
- whose candidature is finally disqualified ;
- whose list obtained less than 5% of votes cast in the region
concerned. In this case, the copy of the results proclamation report
delivered by the competent regional supervisory commission shall
entail order to pay.
(2) The deposit referred to in sub-section (1) above may subsequently be
collected by the representative of the candidate or list of candidates.
(3) In all cases other than those mentioned in sub-section (1)
above, the deposit shall be retained by the public treasury.
