SECTION 414

(1) The prosecution and the civil party shall inform the accused and the person vicariously liable as well as the insurer of the list of their witnesses at least five (5) days before the hearing begins. (2) The accused, the person vicariously liable and the insurer shall also inform the prosecution and the civil party of the list of their witnesses within the time-limit prescribed in sub-section (1). (3) Where the formalities referred to in sub-sections (1) and (2) have not been complied with, the witnesses shall be barred from being heard. However, the court may, with the consent of the parties and of the Legal Department proceed to hear them mention of such consent shall be made in the judgment.
