SECTION 21

(1) Except in cases of offences punishable with death, a warrant of arrest may contain an endorsement that the person to be arrested shall be released if he fulfils the conditions listed in the warrant, in such a case, the endorsement shall specify, apart from the magistrate before whom or the court before which the person to be arrested is to appear: either the number of sureties, if any, and the amount by which they bind themselves to pay in case of non- appearance; or the amount of security to be deposited by the person to be arrested. (2) When such endorsement is made, the judicial police officer shall release the person if the conditions laid down in the preceding sub-section (1) have been fulfilled. (3) The recognizance signed by the person arrested or his sureties or, where applicable, the particulars from the receipt of the security deposited shall be transmitted along with the report on the execution of the warrant to the magistrate before whom or the court before which the person is bound to appear.
